This Privacy Policy for SeatStock ("Company," "we," "us," or "our") outlines how we collect, use, and share your information when you engage with our ticket exchange platform, including any interaction with our website at seatstock.com and any other of our digital properties ("Services"). By providing us with personal information or using the Services, you expressly consent to the information-handling practices described in this Policy. While we always aim to provide complete and transparent information about how we process your personal information, we reserve the right to amend or update this Policy from time to time, or to create additional policies, in order to accurately reflect changed circumstances or new legal requirements. 1. What Information Do We Collect?
Personal Information You Disclose to Us
We collect personal information that you voluntarily provide to us when you interact with SeatStock's services. This may include:
- Phone numbers
- Email addresses
- Names
By providing your phone number, you consent to receive SMS messages from us, including authentication codes and important notifications related to your account and transactions. Message frequency may vary depending on your activity. Standard messaging and data rates may apply. We do not process sensitive information.
In addition, we collect the following:
- Account information– if you register to use our Services, your username, account password, and other information that we may request or that you may provide relating to your account.
- Transactional information– details about your transactions with us, including method of payment, payments received, transaction history, and other information relating to the transactions you engage in.
- Marketing information– details regarding informational and promotional materials you may have requested or received from us, the services in which you are interested, your receipt of promotional communications, and information on your marketing or communication preferences.
- In-app communication information – copies of communications and inquiries you transmit or submit via the platform functionality of our Services to other users, including through email, telephone call, video call, chat, and similar features available in our Services.
- Customer support information– details of any communications or inquiries you submit to us, including technical or customer support requests, through email, calls, chat, or other features available in our Services.
- Device and usage information– details regarding how and when you use our Services, including the device used to connect to our Services, your IP address and device identifier, the frequency and duration of your usage, the pages you view, what websites or search terms referred you to our Services, and information about your interaction with our Services.
When data is anonymized and cannot be used to identify you, it is no longer considered “personal information.”
Payment Data
If you make purchases, we may collect payment data necessary to process your payments, such as your payment instrument number and security code. All payment data is stored by Stripe. If you conduct sales, we may collect payout data necessary to process your payouts with use of your preferred method (i.e., bank account, Venmo, etc.). SeatStock does not collect or store any data related to your payment method.
Information Automatically Collected
Like most digital property operators, we use various technologies to collect certain types of information about the users of our digital properties. Note, the vendors that supply us pixels, tags, web beacons, cookies, and the other tracking technologies discussed below collect your personal information instantaneously and simultaneous to our collection of such information. They may also use such personal information for their own or others' purposes.
The technologies we use on our website and other digital properties include:
- Pixels, tags, web beacons, gifs, and similar code-based technologies. These technologies are small pieces of code that run when a website or other digital properties page or email is loaded. They are used to monitor the behavior of the visitor or email recipient—such as what icons were clicked or whether links in an email were opened—and gather analytics and details about the interaction. For example, when you open our homepage, a pixel may run and generate information based on the visit (e.g., your IP address and what day and time you were on the homepage), and then this information is processed by us or our vendors. Pixels work in conjunction with cookies to let us know what portions of our digital properties are of interest to you and to help us provide you with tailored information. Even if you have disabled or turned off cookies (discussed below), the pixels, tags, and web beacons we use may still detect and collect certain information about your interaction with our website or other digital properties; in other words, these kinds of technologies may disregard any cookie-prohibitive markers or signals.
- Cookies: Cookies are small text files that can be used by websites to make a user's experience more efficient. Our website uses different types of cookies to, among other things, automatically recognize you when you return to our site, store information regarding your preferences, and analyze traffic to our site. The information collected through these technologies may be combined with personal information or aggregated with other information on website visits. - Vendors whose technologies we leverage to provide certain features of our website or other digital properties, such as video players and chat software providers.
- Marketing and advertising vendors that may assist with lead generation, hosting information relating to customers and business partners and potential customers or business partners, marketing automation, advertisement placement and targeting, and marketing campaigns and communications. Examples of these vendors include Meta and LinkedIn.
- Analytics vendors in order to understand our website traffic and usage patterns, optimize our website, track marketing conversions, and identify potential new customers or users.
- Other users of the Services, such as the Seller, if you are a Buyer of a ticket.
- Your school or the educational institution with which you are affiliated.
- Other entities in connection with mergers, sales of company assets, financing, or acquisitions.
- Our business partners, to offer certain products, services, or promotions.
- Our affiliates and related entities, investors, and operational partners.
- Our professional advisors, such as lawyers, accountants, and other similar advisors.

- Regulatory and governmental authorities, law enforcement agencies, and courts, as necessary to comply with applicable laws and regulations, respond to a subpoena, search warrant, or other lawful request for information, or to otherwise protect our rights.

- Enforce or apply the terms and conditions of our website or other digital properties, any terms and conditions of purchase (to the extent applicable), and other agreements between you and SeatStock.

We retain your personal information for as long as necessary to fulfill the purposes outlined in this privacy notice, unless a longer retention period is required or permitted by law.
5. How Do We Keep Your Information Safe?
We employ organizational and technical security measures to protect your personal information, including your phone number. However, no electronic transmission over the internet is 100% secure, so we do not warrant or guarantee complete protection.
6. Do We Collect Information from Minors?
We do not knowingly collect data from or market to children under 13 years of age. If you are a parent or guardian and believe we have collected information from a minor, please contact us.
7. What Are Your Privacy Rights?
We strive to offer our users meaningful control over their personal information.
Account Information
If you would like to review or change the information in your account or terminate your account, you can:
- Log in to your account settings and update your user account.
- Contact us using the contact information provided.
Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained to comply with legal requirements, prevent fraud, resolve disputes, troubleshoot problems, enforce our Terms of Use, and comply with legal requirements.
Opting out of SMS communications
To opt-out of receiving SMS messages from us, you can reply "STOP" to any message you receive, or contact us at [email protected]. Please note that even if you opt-out of receiving SMS messages, we may still send you important transactional messages related to your account and transactions. Standard messaging and data rates may apply.
Opting out of email marketing
You can unsubscribe from our marketing email list at any time by clicking the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, we may still communicate with you, for example to send you service-related emails that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.
8. Controls for Do-Not-Track Features
We do not currently respond to Do-Not-Track browser signals. Many web browsers and some mobile operating systems include a Do-Not-Track (DNT) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
9. Do Residents of Certain Jurisdictions Have Specific Privacy Rights?
The above sections of this Policy describe the categories of personal data processed by us, the purposes for the processing of such personal data, the categories of personal data that may be disclosed to third parties, and the categories of third parties to whom we may disclose personal data. In addition, and for the purposes of processing an application for residency or tenancy, we may collect and verify sensitive data in the form of your citizenship or immigration status.
Under the laws of your state of residence, you may have the right to request (1) that we confirm that we are processing your personal data, (2) access to the personal data we process, (3) correct inaccuracies in the personal data we process, taking into account the nature of the personal data and the purposes of the processing of such personal data, (4) delete the personal data provided by you or obtained about you, subject to certain exceptions under applicable laws, (5) a copy of the personal data that we process, subject to certain limitations and exceptions, or (6) opt out of the processing of your personal data for the purposes of targeted advertising, the sale of personal data, or profiling in furtherance of a decision that produces a legal or similarly significant effect.
In order to exercise any of the above-described rights, you or an agent acting on your behalf must send an email [email protected] with the subject, “Privacy Request.” We may require you or your agent to provide us information that enables us to authenticate your request. If we are not able to authenticate your request using commercially reasonable efforts, we may decline to comply with your request. In addition, for California residents, California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
